Why SSD Claims Are Denied

The vast majority of applications for Social Security Disability benefits are denied. Denials fall into two categories: technical denials and medical denials.

Technical Denials

Social Security Disability benefits are intended for people who cannot work due to a medical condition. While it is possible to earn some income and still be eligible for benefits, if income is higher than the substantial gainful activity (SGA) limit, a technical denial will be issued.

Applications for Social Security Disability Insurance (SSDI) may receive technical denials if the applicant has not contributed the required amount of wages into the Social Security system. In other words, a technical denial may be issued if you have not worked for the required number of years. Not having worked recently enough may also result in a technical denial.

Medical Denials

The Social Security Administration (SSA) has a rigid definition of disability. The first key point is that the medical condition, whether physical or mental, must prevent you from engaging in substantial gainful activity. The second is that the medical condition must be expected to prevent you from working for at least 12 months continuously or to result in death.

What To Do If You Have Been Denied Benefits

Perhaps the most important thing to understand is that a denial does not mean you do not meet the criteria required to get benefits, it simply means that the SSA employee who reviewed your application did not see evidence that you met the criteria. Consider also that these employees have a substantial number of applications to review, so they are not spending a great deal of time looking for information that is not presented clearly.

Thankfully, if you are denied benefits, you have the opportunity to work with a lawyer who can submit a request for reconsideration that shows more clearly that you are indeed eligible for benefits. If that request is not granted, there are additional steps to appeal the denial.
