Types Of Workers' Compensation Benefits

In Texas, there are four types of workers' compensation benefits:

  • Medical benefits
  • Income benefits
  • Death benefits
  • Funeral benefits

At Leticia A. Gonzalez, Attorneys at Law, we help injured workers in San Antonio and statewide get all the benefits they are entitled to under workers' compensation law.

Medical Benefits

These benefits should cover all of the medical treatment necessary to recover from a workplace injury. Our lawyers can help you get the care you need. We can answer questions about choice of doctors and more. We can resolve disputes over whether physical therapy, surgery, or other treatment options are necessary and should be covered.

Income Benefits

Income benefits are one of the most complex aspects of workers' compensation. These benefits can be broken down into a variety of subcategories, including:

  • Temporary income benefits (TIBs) are available if you lose all or some of your wages for seven days or more due to an on-the-job injury.
  • Impairment income benefits (IIBs) are available if you reach maximum medical improvement (MMI) but still suffer from a permanent impairment.
  • Supplemental income benefits (SIBs) are a continuation of IIBs. They are available if you have an impairment rating of a certain level, are unable to return to work or have returned to work at a reduced rate, and meet several other criteria.
  • Lifetime income benefits (LIBs) are available in the most serious cases, such as those in which a work accident has led to the loss of a body part or loss of use of a body part.

We can help you determine what income benefits you are eligible for. We take great care to see that your average weekly wage is calculated correctly, as that is necessary for accurate income benefits. We work hard to see that you get the maximum income benefits.

Death Benefits

These benefits compensate the families of individuals who died as a result of workplace accidents. They cover a portion of the family income that was lost because of the death. Great care needs to be taken so that income is calculated correctly and the family gets what they are entitled to. Our attorneys are committed to the correct handling of these benefits.

Funeral Benefits

These benefits cover some of the cost of funeral expenses after a family loses a loved one in a workplace accident. We will help you get these benefits.

Beyond Workers' Compensation Benefits

Not only will we help you get all the workers' compensation benefits you deserve, we will also review your case to determine if you are eligible for other benefits as well. In some situations, injured employees may be eligible for Social Security Disability. You may also be able to get additional compensation through a personal injury claim.
